Terms & Conditions

Welcome to Xtensity. These Terms & Conditions constitute a legally binding agreement between you ("User", "Candidate", or "Recruiter") and Xtensity Training Services Pvt Ltd. ("Company", "Xtensity", "we", or "us") governing your use of our recruitment platform.

1. Platform Services & Matching Disclaimer

·The Intermediary Service: Xtensity provides an automated technology platform that acts as an intermediary, matching candidate profiles with Job Descriptions (JDs) uploaded by recruiters.

·Automated Shortlisting: Matching and ranking are performed by automated systems, including artificial intelligence. They are an aid to a recruiter’s judgement and not a substitute for it. Xtensity does not warrant that a ranking is complete or correct, that every suitable candidate will be surfaced, or that every candidate surfaced is suitable.

·No Guarantee of Employment or Hiring: Xtensity does not guarantee that candidates will secure interviews or job placements. Similarly, we do not guarantee to recruiters that a subscription will yield a successful hire.

·Verification Responsibility: While we perform basic corporate verification for recruiters, we do not background-check candidates or verify the financial or legal standing of employers. Both parties must conduct their own independent due diligence before entering into an employment contract.

2. Recruiter Subscriptions & Billing

·Subscription Fees: Access to candidate pools and JD matching tools is subject to paid subscription tiers. All fees are non-refundable unless explicitly stated otherwise in a specific service-level agreement.

·What a subscription entitles you to: A subscription permits you to run a stated number of roles during the subscription period, as set out in the plan you purchase. Pricing tiers are clearly mentioned on our online platform and mobile application.

·Definition of a role: A "role" means one job description for one genuine open position. It includes unlimited shortlist rounds for that position subject to the subscription plan the user is on, from the date it is created. Using a single role entitlement for more than one distinct position is not permitted.

·Account Access: Subscriptions are issued to an organisation. More than one authorised representative of that organisation may access it. Sharing credentials with a person or organisation outside the subscribing entity is strictly prohibited and will result in immediate suspension without a refund.

·Taxes: All fees are subject to applicable Indian taxes, including Goods and Services Tax (GST).

3. Resumes You Upload

·Your warranty: Where you upload a candidate’s resume, you confirm that you received it lawfully and are permitted to share it with Xtensity so that we may process your application pipeline. You remain responsible for the accuracy and provenance of what you upload.

·Scope of use: A resume you upload is used only for the specific role you upload it against. It is not made visible to other subscribers, is not added to our searchable candidate pool, and is not used for any other role — including your own other roles — unless that candidate creates their own account.

·Notice to the candidate: We may notify the candidate that their profile has been uploaded, and they may ask us to delete it.

4. Optional Paid Services for Candidates

Creating a profile, being matched and applying for roles are free for candidates and will remain so. We may offer optional paid services, such as training courses or increased visibility of your profile.

These are always optional. Purchasing them does not guarantee an interview, an offer, or preferential treatment in any employer’s decision, and declining them does not disadvantage you in matching.

5. User Conduct & Acceptable Use

All users agree not to:

·Post fraudulent, deceptive, or non-existent job listings.

·Charge candidates any fees for scheduling interviews, processing applications, or offering training as a prerequisite for a job through this platform. This restriction applies to users of the platform; it does not restrict optional services offered by Xtensity under clause 4, which are never a prerequisite for any role.

·Upload resumes or corporate JDs containing content that violates third-party intellectual property or privacy rights.

·Deploy scrapers, spiders, crawl bots, or automated scripts to systematically harvest candidate resumes or system data.

6. Intellectual Property

·All proprietary matching algorithms, software code, user interface designs, logos, and trademarks displayed on the app are the exclusive property of Xtensity Training Services Pvt Ltd.

·Users retain ownership of the raw data they upload (resumes or JDs) but grant Xtensity a non-exclusive, worldwide, royalty-free license to host, parse, and process this content to deliver matching services.

What our systems produce from that content is ours: the structured profile extracted from a resume, the scores, reasoning and rankings our matching produces, and the comparisons between candidates. These are our assessment rather than content you supplied, and they are not released in a data export — see Section 8 of the Privacy Notice, which this clause supports. Your right to a summary of the personal data we process about you is unaffected.

7. Limitation of Liability

To the maximum extent permitted under Indian law, Xtensity Training Services Pvt Ltd. shall not be liable for:

·Any employment disputes, salary payment failures, or workplace misconduct arising between candidates and recruiters met through the app.

·Indirect, incidental, or consequential damages resulting from platform downtime, service interruptions, or third-party server failures.

·Inaccurate, exaggerated, or falsified information uploaded to the platform by any user.

8. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any legal disputes, claims, or proceedings arising out of your use of the platform shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra (the city of the Company’s registration).
